Terms of service

The agreement between Neurocareva and the clinician or practice using NeuroScribe. Written to be read, not to be survived.

The agreement

These terms apply between Neurocareva (“we”) and the individual clinician or practice that creates an account (“you”). Creating an account means you accept them. If you are accepting on behalf of a practice, you confirm you are authorised to bind it.

Clinical responsibility

NeuroScribe drafts documentation. It does not practise medicine. You are the clinician of record for every patient in your account and you remain fully responsible for the accuracy of anything you sign.

Generated notes are drafts until a licensed clinician reviews and signs them. The product will not add a clinical finding the encounter does not support, but transcription and generation can both be wrong, and reviewing for that is your job, not ours. Do not sign a note you have not read.

The clinical assistant produces suggestions and reference material. It is not a diagnosis, not a prescription and not a second opinion. Clinical judgement remains yours.

Protected health information

If you use NeuroScribe to document patient care you are a covered entity, or the business associate of one, and we act as your business associate under HIPAA. A Business Associate Agreement governs that relationship and we will execute one with your practice on request, before any protected health information goes into the product.

Where a signed BAA and these terms conflict on the handling of protected health information, the BAA governs. Our obligations as a business associate, including breach notification and the agreements we hold with our own subcontractors, are set out in the privacy policy.

Your account

One account is for one clinician, except on Clinic, which is licensed per provider. Sharing a single login between clinicians breaks the audit trail, makes the note attribution wrong, and is not permitted.

You are responsible for keeping your credentials secure. We strongly recommend turning on two-factor authentication, which is available on every plan. Tell us promptly if you believe an account has been accessed by someone who should not have access to it.

Plans, billing and allowances

Subscriptions are billed in advance through Paddle, who act as merchant of record. Billing is monthly.

Each plan includes a monthly note allowance. Allowances reset on your billing date and unused notes do not carry forward. If you reach your allowance you can move to a larger plan at any time, which takes effect immediately and is prorated for the rest of the month.

Clinic (per provider, from 3)$119 a month, 300 notes a month

You can change plan at any time from billing settings. Upgrades take effect immediately and are prorated. Downgrades take effect at your next billing date. Prices may change with at least 30 days’ notice by email, and a price change never applies to a period you have already paid for.

Cancellation and your data

Cancel at any time from billing settings, without contacting anyone. Your account stays active until the end of the period you have paid for. We do not refund partial months, and we do not put a retention offer in front of the cancel button.

Your notes remain yours. Export them to PDF or Word before you close the account. If you ask us to delete the account, we delete your charts, notes and learned styles, and confirm when it is done. See the privacy policy for retention periods.

Acceptable use

Do not upload data you are not entitled to process. Do not attempt to access another provider’s records, probe the service for vulnerabilities without telling us first, resell access, or use the product to generate documentation for an encounter that did not take place.

If you find a security issue, tell us at security@neurocareva.com before telling anyone else and we will work the issue with you.

Availability

We aim for the service to be available whenever you are seeing patients, and we do maintenance outside United States clinical hours wherever possible. We do not currently offer a contractual uptime guarantee, and we would rather say that plainly than publish a number we are not yet in a position to stand behind.

Liability

To the extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for clinical decisions, for the content of a note you signed, or for loss arising from data you did not export before closing your account.

Nothing in these terms limits liability that cannot be limited by law.

Changes and contact

If we change these terms materially we will email account holders before the change takes effect. Continuing to use the service after that date means you accept the revised terms.
